MDU Segment States Case Against
Perpetual MDU Agreements
FCC Cable Services Bureau
staffer Eloise Gore yesterday heard concerns about the state
of multichannel video competition in multiple-dwelling units
from industry representatives at a meeting of the Satellite Business
and Communications Associations new MDU segment. Attendees
voiced their frustration with exclusive, perpetual contracts
between landlords and cable operators that prevent other companies
from competing for tenant subscriptions, MDU segment Chairman
Bob Palle said. Several proceedings pending at the FCC could
further open the MDU market to new entries, Gore noted. Speaking
after the meeting, Gore would only say the commission recognized
the concerns raised at the meeting, but gave no indication of
whether or when the FCC would act.
EchoStar Continues Program Access Complaint Battles
WASHINGTONEchoStar Communications last week asked the
FCC to reconsider its denial of EchoStars complaint against
the Speedvision and Outdoor Life Networks. The FCC last month
denied EchoStar's charge the channels wrongly cut off EchoStar
from their programming because the DBS service allegedly violated
the terms of a carriage agreement. EchoStar last week said the
commission could have ruled in EchoStars favor because
the alleged contract violation by EchoStar was not the real reason
for the cut-off. The programmers have until July 29 to respond.
Meanwhile, Fox/Liberty Networks told the FCC it should reject
out of hand EchoStars recent program access
complaint against Fox Sports Arizona and prohibit the DBS service
from filing any more complaints based on the parties 1996
carriage agreement. Fox told the FCC July 13 that EchoStars
latest complaint stemmed from a 1996 contract the FCC already
said is too old to complain about. EchoStar has until July 27
to respond.
